£16 Million Insurance Win

In Short: London’s ExCeL exhibition center and a few other lucky policyholders just scored a legal win, with the Court of Appeal deciding that the COVID-19 lockdowns triggered their insurance policies' “at the premises” clause. This victory could lead to thousands of businesses lining up to make their own claims, likely giving some insurers a headache.

What’s going on?

Back in March 2020, when the world went into full lockdown mode, ExCeL and a handful of other businesses had their doors shut due to the pandemic. Their insurance policies had a clause covering interruptions due to diseases “at the premises," but insurers argued that only a localized outbreak counted—not a nationwide lockdown. The Court of Appeal, however, disagreed, ruling that the COVID-19 cases at the ExCeL and other businesses were part of the reason for the lockdown, meaning they can cash in on their policies. This follows an earlier High Court decision in favor of the policyholders, despite insurers doing their best to sidestep responsibility.
